Bail and arrest
Does non-bailable mean bail is impossible?
No. Bail may be available subject to judicial discretion, statutory restrictions and the facts. “Non-bailable” does not itself mean “no bail”.
What is anticipatory bail?
It is a direction for release if arrested on a non-bailable accusation. An application may be made to the Sessions Court or High Court; exclusions and special-law restrictions must be checked.
Is bail available as a right for a bailable offence?
Generally, yes, subject to the statutory conditions. BNSS section 478 also addresses release on a personal bond where an indigent person cannot furnish surety.
Can an arrested person meet a lawyer during interrogation?
BNSS section 38 allows an arrested person to meet an advocate of choice during interrogation, though not throughout it.
Do all existing cases now follow BNSS?
No. Section 531 preserves CrPC procedure for specified proceedings pending immediately before BNSS commenced. Check the particular proceeding and applicable transitional rules.
Court records and case status
How can I check my case status online?
Use the official eCourts Services portal with the 16-character alphanumeric CNR, without spaces or hyphens. Where the CNR is unavailable, use the offered case-number, party-name or other search options.
What should I collect before discussing a criminal matter?
Prepare a brief chronology, FIR or complaint if available, notices, relevant orders, case number, court details and upcoming dates. Keep originals safe and identify missing documents. Requirements depend on the matter.
Where can I find court-specific information?
Start with the relevant court’s official website. Our courts page links to official resources for the Supreme Court, Delhi High Court and district courts. Check the court’s current instructions for the service you need.
Legal aid
Who may qualify for free legal aid?
Eligibility is governed by the Legal Services Authorities Act. Categories include women, children, persons in custody and other specified groups; income-based eligibility also exists. Contact the relevant Legal Services Authority for assessment.
Can a financially independent woman apply for legal aid?
